Terms and Conditions

1. Preview: Friday, November 24th , 9am - 10:30am

2. You must be registered in order to bid. Registration requires a  $500 refundable deposit, Cash ONLY for all in person bidders. Those bidding in person must provide deposit in cash to register. Checks are not accepted. Any failure to pay your invoice on the day of auction will result in the loss of your deposit. 3. All vehicles are sold 'As is- Where is' with no guarantees of any kind. All sales are final and no returns are allowed for any reason. Vehicles may be started and run by Malama Auctions staff only. No test drives are permitted. 4. Cash is the only accepted form of payment, no checks will be accepted. All invoices must be paid in full by 1pm, November 24th . If you have not paid for your vehicle by this date and time, deposits must be forfeited. If for any reason payment is unable to be processed on your credit card your account will be suspended. To reinstate your account, full payment for your outstanding invoice, a $100 service charge and any other applicable charges or fees must be paid. 5. Anyone caught tampering with tags, merchandise or evidence of theft will be prosecuted to the fullest extent possible. 6. Malama Auctions will not be held responsible for any inconsistencies in description announced or printed, therefore buyers are responsible for inspecting all vehicles and deciding for themselves if the vehicle they have seen is what they want to buy. 7. According to Federal Uniform Commercial Code (UCC 2-238) At the closing of each auction lot there is a legal binding contract for the purchase of the lot. 8. Buyers are responsible for the moving, transport and removal of all vehicles purchased. Malama Auctions cannot provide or ensure assistance for removal of your vehicles. 9. Malama Auctions & Appraisals staff reserve the right to bid on and purchase merchandise. 10. All items must be picked up at the specific times stated above per the Terms and Conditions. If bidder fails to arrive or make arrangements by the specified pick up time, a $50 per day storage fee will apply for each calendar day until vehicle is picked up. Storage fees must be paid before vehicle can be removed from the premises. By December 15th, 2017, your items will be considered forfeited and may be sold again at a future sale, discarded or otherwise disposed based on Malama Auctions discretion. 11. There is a taxable 10% buyers premium added to the hammer price of all lots. 12. This will be a live simulcast auction. Bidding will take place onsite with a live call. Online bidding will be available for pre-bids, max bids or real time bidding while the auction is being conducted. Max bids may not always be the winning bid even if the vehicle sells at or below the max bid placed. Bidding increments will be at the discretion of the auctioneer. In the event of a tie bid, the final undisputable decision will be up to the auctioneer. 13. The winning bidder and the person the vehicle title will be transferred to must be the same, or any additional title holding parties must be present with valid ID’s.
